Dùng dao, chĩa đánh nhau gây thương tích 6% và 19%, 2 người đều bị khởi tố

Ngày 21.9, tin từ Công an thành phố Cần Thơ cho biết Công an xã Vị Thanh 1 đã khởi tố vụ án, khởi tố bị can, bắt tạm giam đối với Võ Hoàng Chí (50 tuổi) về hành vi "sử dụng trái phép vũ khí quân dụng" và Nguyễn Quốc Việt (57 tuổi, cùng ở ấp 9A1, xã Vị Thanh 1) về hành vi "cố ý gây thương tích".

Theo điều tra ban đầu, trong quá trình sinh sống tại địa phương, Chí và Việt nhiều lần xảy ra mâu thuẫn, rồi dẫn đến đánh nhau vào ngày 26.4. Việt dùng cây chĩa dài hơn 3,1 m làm hung khí để đánh Chí; còn Chí dùng cây dao dài hơn 0,6 m để đánh lại Việt. 

Trong quá trình xảy ra xô xát, Chí đã dùng dao gây thương tích cho Việt với tỷ lệ 6%. Lực lượng chức năng xác định cây dao mà Chí sử dụng là hung khí nguy hiểm, có tính sát thương cao. Do đó, hành vi của Chí có đủ yếu tố cấu thành tội "sử dụng trái phép vũ khí quân dụng" theo quy định tại khoản 1, điều 304, bộ luật Hình sự.

Còn với Việt, việc dùng chĩa (phần thân gỗ) tấn công cũng đã khiến Chí bị thương tích 19% nên đủ yếu tố cấu thành tội "cố ý gây thương tích" theo quy định tại khoản 1, điều 134, bộ luật Hình sự.

Hiện vụ việc trên được Công an xã Vị Thanh 1, thành phố Cần Thơ tiếp tục điều tra, làm rõ để xử lý theo quy định pháp luật.
